Newark Village Board meets

On Tuesday evening, the Newark Village Board took care of approximately 12 agenda items and went into executive session to discuss personnel issues.

A public hearing was held prior to the regular board meeting regarding potential small cities grant applications. It is the intent of the Village Board to pursue two grant applications to update the infrastructure at the Newark Industrial Park and Silverhill Technology Park.

Mayor Fred Pirelli reluctantly proposed that the board approve an additional building plan by C.A.S.H on Blue Cut Rd. Pirelli, not happy with the tax-exempt status of the apartments, admitted that there's nothing that can be done about the situation. Pirelli said, "Our taxable base is being picked away by tax-exempt projects."

Village Attorney Art Williams indicated that the restructuring of Showplace 5 Theater agreements with banks and the village is underway, with a closing expected around February 1. A resolution was amended regarding Showplace 5, indicating that the Village will file either a first lien on the building's equipment or a second lien on the personal property of the business owners. As result of the restructuring , the village will receive $148,500 in proceeds.

Industrial Park zoning is being planned, with an additional 50 acres needing identification. Code Enforcement Officer Mark Peake said he will be taking a proposal to the Planning Board for approval. Peake told the board that care must be taken not to preclude the types of enterprises such as a Veterinary Hospital and Health Club that recently signed to locate in the present industrial park area.

Vacation buy-outs: Some village employees have indicated a desire to be paid for unused vacation time. Pirelli reminded the board that village policy does not allow this practice. However, Pirelli said that these employees were unable to use their vacation time, due to shortages of help. He a one-time exception be granted. The board tabled the issue for further review.

Don DePauw, owner of the building at the corner of South Main and East Miller, asked for permission to use parking spaces in the village-owned lot directly behind his property. DePauw is attempting to gain zoning board approval to convert the second floor space to apartments. One of the drawbacks is the lack of parking. Attorney Art Williams suggested that the village enter into a long-term agreement with DePauw to lease six spaces directly behind his building. The board voted to grant this easement.

Other action:

- Authorized Village Clerk/Treasurer Michael Tonovitz to attend the NYS Business Show.

- Gave the Multiple Sclerosis Society permission to hold a benefit "walk" on April 18.

- Approved the award of a contract to accounting firm Butera-Sinicropi-Healy, for auditing proposals for two years.

- Signed contract to provide the Town of Arcadia with fire protection for 1999 for $39,000.

- Authorized the re-hiring of Code Enforcement Officer Charles Ackerman, who recently retired, on an as-needed basis of $25 per hour.Clerk/treasurer Mike Tonovitz gave an update on the progress on budgets for the coming fiscal year.

The mayor reminded all present that built in to any budget will be costs for salary increases, lawsuit obligations and Alex Eligh Community Center debt. Additionally, the board agreed that no transfers will be made from the water fund to the general fund. A goal of a maximum tax increase of 4% is planned, and a total unappropriated surplus of $300,000 is a must.
